The court has reviewed in camera the redacted portions of the administrative record as to which Plaintiffs seek emergency disclosure, namely, (1) 20 STATE 30920, AR 000013-16, and (2) the four webinar slide decks, AR 000198-253. The court lacks sufficient information to decide whether Defendants have validly redacted portions of 20 STATE 30920 pursuant to the law enforcement privilege. That said, the relevance of the redacted portions is not apparent to the court, as none of the portions pertain to diversity lottery visas or any other visa category impacted by Presidential Proclamations 10014 and 10052. Nor do the redactions bear on the issues of final agency action or Plaintiffs' standing. The court therefore declines to make a privilege determination on an emergency basis. As for the webinar slide decks, the court can discern no relevance of the redacted portions, with one exception. The redactions, generally speaking, do not pertain to any of the visa categories at issue in this case and do not reflect or convey what could be considered a final agency action. The sole exception in terms of relevancy appears on AR 000201, where bullet points two and three seem to address the status of visa processing operations. That information could be probative of the court's ability to redress any alleged injury. Defendants, therefore, shall disclose bullet points two and three on AR 000201; the remainder of that page may remain redacted. These rulings are without prejudice to future reconsideration either after final briefing on the motions for preliminary injunction is complete or if this matter proceeds past the preliminary injunction stage. "Leave to amend a complaint under Rule 15(a) shall be freely given when justice so requires.'" Firestone v. Firestone, 76 F.3d 1205, 1208 (D.C. Cir. 1996) (quoting Fed. R. Civ. P. 15(a)). "Although the grant or denial of leave to amend is committed to a district court's discretion, it is an abuse of discretion to deny leave to amend unless there is sufficient reason, such as 'undue delay, bad faith or dilatory motive... repeated failure to cure deficiencies by [previous] amendments... [or] futility of amendment.'" Id. (quoting Foman v. Davis, 371 U.S. 178, 182 (1962)). None of the Foman factors are present here; Defendants do not contend otherwise. Feb 8, 2022 | MINUTE ORDER. Defendants have 253 moved to stay the court's Order of October, 13, 2021, pending appeal, and have asked the court to "act on [the] stay request by February 15, 2022." Id. at 2. Otherwise, Defendants say, they will "seek stay relief at that time from the D.C. Circuit if Defendants do not obtain relief from the Court." Id. Defendants' request for expedited consideration is denied. Defendants have offered no reason at all for the court to speed up briefing of this matter, and Defendants themselves have demonstrated a lack of diligence in seeking a stay. They waited nearly the full 60 days to file their notices of appeal, and then waited two more months to file their motion for stay. The irony of Defendants' position is not lost on the court. Defendants routinely argue that plaintiffs who seek expedited adjudication of visas should be denied such relief because it would improperly move them to the front of the line. Yet, that is precisely what Defendants seek to do here: leapfrog plenty of litigants who are asking for this court's time and attention.
