Apr 9, 2019 | MINUTE ORDER: In ruling on Plaintiffs' prior Motion to Proceed Under Pseudonyms, Dkt. 1, Chief Judge Howell ordered that Exhibit A to Plaintiffs' motion "remain under seal until further order of the Court" subject to "any further consideration by the United States District Judge to whom this case is randomly assigned." Dkt. 2 at 7. Following that memorandum opinion and order, Plaintiffs filed a "Notice of Motion to Seal Portions of the Record," Dkt. 5, as well as a separate motion "seeking a protective order" to seal "Exhibit A... to the Jane Doe Plaintiffs' Motion to Proceed Under Psedonyms [Dkt. 1]," Dkt. 6. Because the Notice of Motion to Seal Portions of the Record, Dkt. 5, references a "memorandum in support filed with it" but contained no attachment nor identified any portion of the record to be sealed, the Court understands that document to seek the same relief identified in Dkt. 6. To the extent that both motions seek an order that Exhibit A to Plaintiffs' Motion to Proceed Under Pseduonym, Dkt. 3, shall remain sealed, it is hereby ORDERED that the motions are GRANTED. Having reviewed the record, Plaintiffs' motions to date, and Chief Judge Howell's memorandum opinion and order, the Court agrees that Plaintiffs' significant interest in maintaining their anonymity at this stage of the litigation is sufficient to overcome any general presumption in favor of open proceedings. See United States v. Hubbard, 650 F.2d 293, 317-321 (D.C. Cir. 1980). Accordingly, for the reasons set forth in Chief Judge Howell's memorandum opinion and order, it is hereby ORDERED that Exhibit A to the Jane Doe Plaintiffs' Motion to Proceed Under Pseudonyms shall remain sealed pending further order of the Court and that Defendant is prohibited from publicly disclosing the Plaintiffs' identities or any personal identifying information that could lead to the identification of the Plaintiffs by non-parties. Sep 3, 2019 | MINUTE ORDER: On August 7, 2019, the Court denied Plaintiffs' second motion to proceed under pseudonym. Dkt. 39. Because the opinion discussed certain private information, the Court filed its opinion under seal and provided the parties with an opportunity to propose redactions before the Court filed a public version of the opinion. Subsequently, Plaintiffs filed an amended complaint omitting Doe 4 as a party to the litigation. See Dkt. 40. Plaintiffs have also now filed proposed redactions to the Court's opinion, and Defendant does not oppose Plaintiffs' request that the Court adopt the proposed redactions. Dkt. 46. Although those redactions are more extensive than the Court envisioned when it issued the opinion, the fact that Doe 4 is no longer a party to the litigation alters the balance between the public interest in judicial transparency and Doe 4's interest in privacy. In particular, many of the proposed redactions do not reveal detailed, personal information about Doe 4 but might reveal her identity. Because she has declined to participate in the litigation, the public interest in knowing her identity is substantially diminished. Jun 9, 2020 | MINUTE ORDER: Upon consideration of Defendant's motion for sanctions, Dkt. 73 , it is hereby ORDERED that the motion is DENIED without prejudice. Jones Day argues that Plaintiffs brought their claims "that Jones Day paid men more than women," without factual basis or investigation, and while ignoring evidence that undermined those claims. Dkt. 68 at 1. Federal Rule of Civil Procedure 11(b)(3) provides that "[b]y presenting to the court a pleading... an attorney... certifies that to the best of the persons knowledge, information, and belief, formed after an inquiry reasonable under the circumstances... [that] the factual contentions have evidentiary support or, if specifically identified, will likely have evidentiary support after a reasonable opportunity for further investigation or discovery." To the extent that Jones Day argues that Plaintiffs failed adequately to investigate their claims before initiating this lawsuit, the Court is unconvinced. First, "[w]hat constitutes 'reasonable inquiry' depends on the circumstances of the case." Duncan v. WJLA-TV, Inc., 106 F.R.D. 4, 6 (D.D.C. 1984). Here, Plaintiffs faced two considerable challenges in conducting a pre-filing investigation into pay disparities - both an alleged formal pay secrecy policy disincentivizing others from sharing their pay information with Plaintiffs and a lack of access to Defendant's organizational pay data. Second, Rule 11 "is not intended to chill an attorney's enthusiasm or creativity in pursuing factual or legal theories. The [C]ourt is expected to avoid using the wisdom of hindsight and should test the signer's conduct by inquiring what was reasonable to believe at the time the pleading, motion, or other paper was submitted." Fed. R. Civ. P. 11 Advisory Committee Notes. Although Defendant may dispute the legal sufficiency of Plaintiffs' basing their claims in part on (1) Defendant's alleged failure to pay Plaintiffs at "Cravath" rates, (2) Plaintiffs' theory extrapolating pay disparities from incidents of alleged gendered harassment, and (3) disproportionate ratios of men in the firm's partnership, these theories are not so frivolous or beyond-the-pale to warrant sanctions. Third, Jones Day argues that Plaintiffs ignored evidence that undermined or contradicted their allegations, but a Plaintiff is not prevented from bringing a claim simply because she encounters some evidence that does not support her theory. To the extent that Jones Day argues that the claims brought by Plaintiffs are objectively without factual support, Jones Day's motion for sanctions relies on factual assertions made by Jones Day pertaining to both Plaintiffs' and third parties' compensation and work. It would be premature for the Court to pass on the veracity of these assertions in deciding Defendant's motion for Rule 11 sanctions at this stage in the litigation, before Plaintiffs have had the opportunity to conduct relevant discovery. A pre-discovery motion for Rule 11 sanctions is not an appropriate substitute for a motion for summary judgment. Cf. Hedgeye Risk Mgmt., LLC v. Heldman, 412 F. Supp. 3d 15, 35 (D.D.C. 2019) (discussing a plaintiff's ability to rely on discovery to develop evidence for claims that it brought based on "sufficient circumstantial evidence objectively and reasonably to infer" that the defendant was liable for the claim alleged); Quick v. EduCap, Inc., No. 17-1242, 2019 WL 95566, *2 (D.D.C. Jan. 3, 2019) (discussing general inappropriateness of granting a motion for sanctions "[a]t the pleading stage," when "ordinarily there is little or no evidence before the Court at all" (quoting Tahfs v. Proctor, 316 F.3d 584, 595 (6th Cir. 2003))). Finally, the Court stresses that "Rule 11 sanctions are a harsh punishment," Robinson-Reeder v. Am. Council on Educ., 626 F. Supp. 2d 11, 18 (D.D.C. 2009) (quoting Sharp v. Rosa Mexicano, D.C., LLC, 496 F. Supp. 2d 93, 100 (D.D.C. 2007)), which a court should impose only when those sanctions are clearly warranted. Here, the Court does not yet know enough about the relevant facts to determine whether Plaintiffs' allegations are so baseless that sanctions are warranted. Rule 11 is intended to deter and to punish litigation abuses. It is not a means of obtaining an early resolution of the merits of a dispute.
